We may collect your personal information for a variety of reasons and in a variety of ways. This Privacy Policy contains important information regarding our privacy practices and the choices it offers you with respect to your personal information. Scope of this Privacy Policy.

This Privacy Policy applies to our collection and use of personal information. This personal information may take many forms, including your name, home or other physical address, email address, telephone number, fax number, organization name, and/or job title.

Information Collection.

We collect personal information from you. This information may include:

  • Information about you that you provide us, including through your use of forms on the website and our mobile applications (“Sites”) , by contacting us, or by providing us information about you in order to complete a transaction; and
  • Information we collect by automated means when you visit our Sites, use our services, or view our online advertisements.

Our Sites may contain links to websites operated by others whose privacy practices are different from ours. This Privacy Policy does not apply to any information collected about you through your use of such links or that you may provide on the websites you reach by utilizing those links. We are not responsible for the content or privacy practices of websites linked to the Sites or any other sponsored websites that are not designed and developed by RotoMetrics®. You are encouraged to use common sense when using our Sites and review the privacy practices of each website you elect to visit before submitting your personal information.

Information Use.

We take your privacy very seriously and therefore, we do not exchange, lease, or sell the personal information about you that you provide to us, or which we collect when you visit our Sites except: (i) when we have asked for and obtained your explicit (opt-in) consent; or (ii) in the event that we sell or buy any business or assets, in which case we may disclose your personal information to the prospective seller or buyer of such business or assets. Further, we may use this personal information for our normal business operations, and to comply with our legal obligations.

Data Security.

We are concerned with the security of your personal information and consider the protection of personal information we receive from you as critical to our mission of delivering unrivalled software, products, and services to our customers. We deploy a combination of reasonable and appropriate physical, technical, and administrative safeguards to protect against the loss, misuse, unauthorized access, disclosure, tampering, alteration, and unauthorized destruction of any personal information. We follow generally accepted security standards in our operations to protect the security of your personal information, both internally and from outsiders, and to ensure the integrity of the personal information we process, taking into account the relative risks involved and the nature of the personal information in question. Unfortunately, with any transmission over the Internet, there is always some element of risk involved in submitting personal information.

Data Access, Integrity, & Choice.

To the extent we collect or use any of your personal information, we want that information to be reliable, accurate, complete, timely, and relevant to its intended use. To accomplish this goal, we provide individuals with reasonable means of access and the ability to request data corrections or deletions.

In Detail

When we use the term “personal information” in this Privacy Policy, we mean information that identifies, or can be used to identify an individual. This may take the form of, among other things, an identification number, name, title, office/work location, e-mail address, payment information, telephone number(s), photo, or home address. Personal information does not include “Usage Data,” which we define as encoded information, aggregate information, anonymized information, or information that is publicly available and not combined with non-public personal information.

This Privacy Policy applies to personal information:

  • You provide to us voluntarily; and
  • We collect about you, as further described herein.

Information We Collect.

Personal Information You Voluntarily Provide. If you voluntarily provide us with personal information, for example your name, email address, or phone or mobile number, we collect this personal information about you. You may voluntarily provide this information to us in a variety of ways, including by filling out online forms, providing us with personal information in order to initiate or complete a transaction, or by contacting us with questions about the Sites or our products and services.

Personal Information We May Automatically Collect. When you use our Sites, we automatically collect information on the type of device you use, operating system version, and the device identifier. We use cookies and other technologies to collect information about you when you visit our Sites. This information may include:

  • Your browser type and operating system;
  • Web pages you view;
  • Links you click;
  • Your IP address;
  • Site(s) you visited before coming to our site(s); or
  • Device Identifier.

Passive Information.  We use this data for system administration, to assess the traffic to our Sites, to maintain and improve the Sites, and to analyse trends in the aggregate and effectively administer the Sites.

Tracking Technologies.  We may use cookies or similar technologies to improve your experience on our Sites, for example, to personalize features of the Sites for you, to analyse the traffic, such as total visitors to pages viewed on the Sites, and to make improvements based on the data we collect, and to gather demographic information about our user base as a whole. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our Sites or services.

We partner with a third party to display advertising on our Sites or to manage our advertising on other websites. Our third party partner may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests.

We use mobile analytics software to allow us to better understand the functionality of our mobile applications on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personal information you submit within the mobile application.

We do not ask for, access, or track any location-based information from your mobile device at any time while you are downloading or using our mobile applications or services.

Use and Transfer Information.

How we use your information internally.  We may use your personal information to enter into or fulfil our duties under a contract with you. We may also use this information for our legitimate interests to contact you for various other business reasons, such as to:

  • Market our products and services to you;
  • Set up your user account;
  • Contact you on behalf of our affiliated companies or external business partners about a particular offering that may be of interest to you;
  • Ask you about your experience with our company, the Sites, or our products and services;
  • Protect against or identify possible fraudulent transactions;
  • Determine the effectiveness of our advertising; and/or
  • Enforce our Terms and Conditions and otherwise manage our business.

Where we rely on legitimate interests as a reason for processing your personal information, we have carefully considered whether or not those interests are overridden by your rights and freedoms and have concluded that they are not.

How we use your information to comply with legal requirements.  We may disclose certain personal information to comply with the law, such as to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

We may also disclose certain information:

  • If we are required to bring, or defend against, litigation, or any regulatory proceeding between, or relating to, you and us; or
  • We have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may have breached the Terms of Use of one of our Sites or who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Sites users, or anyone else who could be harmed by such activities.

How we share your personal information. While we do not sell, rent, or lease any personal information to third parties, we may disclose information about you to our agents, such as vendors and service providers, acting on our behalf under our instructions for the limited and specific purpose of assisting us with our normal business operations. In no event will that limited and specific purpose be inconsistent with this Privacy Policy. In all cases, these agents may only use this information in connection with providing services to us.

Further, if you use our Sites to connect with third party services, you authorize us to and we may use information from and about you, on your behalf, to interact with these third party services based on your specific requests.

If we or one of its affiliates, subsidiaries, or business units is involved in a merger, acquisition, or sale of all or a portion of its assets during the normal course of business, personal information we may have collected from or about you may be assigned to, transferred to, or acquired by another company. In such case, you will be notified via email and/or a prominent notice on our Sites of any change in the control or use of your personal information, as well as any choices you may have regarding your personal information.

Finally, if any bankruptcy or reorganization proceeding is brought by or against us, personal information we may have collected from or about you may be considered an asset of ours and may be transferred to third parties. In such cases, you will be notified via email and/or a prominent notice on our Sites of any such transfer of your personal information and we will use reasonable efforts to try to ensure that the transferee’s use of this information will be in a manner consistent with this Privacy Policy.

How your information may be transferred.  We take steps to protect personal information no matter what country it is stored in or transferred to. We have procedures and controls in place, as appropriate, to help ensure this. That said, your personal information may be transferred to, stored, and processed in a country other than the one in which it was provided, including the United States. When we make a transfer of your personal information out of the EU, we do so in accordance with applicable data protection laws, including on the basis of a Commission adequacy decision, where the transfer takes place pursuant to recognized appropriate safeguards, and/or where a specific derogation is permissible.

Data Security.

We take appropriate steps that we believe are reasonable to protect the security of your personal information on our system, both internally and from outsiders, and to ensure the integrity of the personal information we collect. We use a combination of technological, physical, and policy methods to protect this personal information, such as, for example, requiring a password to access our network, employing firewall and system log security, and providing employee policies and training regarding appropriate use of personal information. You are responsible for maintaining the secrecy of your passwords and any account information. Please be aware that we will never ask you for your password in an unsolicited phone call or e-mail.

Access & Integrity. 

You have the right to ask us to provide you with all the information we store on you; you have the right to ask us to rectify, complete, or delete your personal data, to restrict its use, and to port your data to another organization; you have the right to request additional information about the handling of your personal data; and you also have the right to object to the processing of your data by us in some circumstances and, where we have asked for consent to process your data, to withdraw this consent (“Individual Rights”). There are exceptions to these Individual Rights, however. For example, access to personal data may be denied in some circumstances if making the information available would reveal personal information about another person or if we are legally prevented from disclosing such information.

Purpose Limitation. We will not process your personal information in a way that is incompatible with the purposes detailed in this Privacy Notice.


We give you choices about how we communicate with you.

  • Digital / Electronic Communications (examples: email, mobile). We only send you promotional mobile or email messages if you explicitly ask to receive these (opt-in). You can stop receiving promotional mobile and email messages from us by following the instructions provided in any such message you receive.
  • Postal Mail. Where permitted by law, we may mail you unsolicited offers or product information that we believe is of interest to you. You can stop receiving promotional postal mail from us. Promotional postal mail may contain opt out instructions, and you can stop receiving promotional postal mail by following those instructions.

You can also stop receiving promotional email or postal communication from us by contacting our US or EU Privacy Managers. Please place the word “UNSUBSCRIBE” in the “Regarding” line of your letter, and provide your contact details to enable the US or EU Privacy Manager to identify you and complete your request.

Some categories of personal information, such as race, national origin, and sexual orientation are considered sensitive or “special”. If you are located in Europe or Switzerland, we will give you the opportunity to affirmatively and explicitly consent (opt-in) to the disclosure of the information to a non-agent third party or the use of the information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. RotoMetrics® will provide individuals with reasonable mechanisms to exercise their choices.

PLEASE NOTE: If you choose to stop receiving promotional messages from us, we will honor your request. However, we may still need to send you service-related communications.


We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, and enforce our agreements. We also retain log files for internal analysis purposes. These log files are generally retained for a short period of time, except where they are used for website security, to improve website functionality, or we are legally obligated to retain them for longer time periods.  Where we rely on legitimate interests as a reason for retaining your personal information, we have carefully considered whether or not those interests are overridden by your rights and freedoms and have concluded that they are not.

Dispute Resolution.

If you have questions or complaints regarding our use of personal information in accordance with this Privacy Policy, we encourage you to first raise any concerns to our US or EU Privacy Manager using the contact information provided above and below. We will investigate and attempt to resolve any complaints and disputes regarding use or disclosure of personal information in accordance with the principles contained in this Privacy Policy.

If for some reason we have been unsuccessful in resolving your concerns, you may of course contact your local data protection authority (“DPA”) to assist in resolution of your concern.

We will regularly audit our privacy processes and practices to verify compliance with this Privacy Policy and will correct any deficiencies.

Any employee that we determine has intentionally violated this Privacy Policy will be subject to disciplinary action up to and including termination.


We may update this Privacy Policy to reflect changes to our information handling practices. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on our Sites prior to the change becoming effective.
